CountUp Terms of Service
CountUp is a web analytics service provided by NextLevelSolutions OÜ (“we”, “our”, or “us”), registered under №17087531 and located at Tornimäe tn 5, 10145, Tallinn, Harju maakond, Estonia.
These Terms of Service (“Terms”) govern your use of CountUp. By accessing and using our service, you agree to these Terms in full. If you disagree with these Terms or any part of these Terms, you must not use CountUp.
1. Service Description
CountUp is a Software-as-a-Service (SaaS) application designed to empower website owners and marketers. By integrating our tracking snippet onto your website, you gain access to comprehensive statistical data, offering insights into user behavior and the sources of your web traffic. This information is pivotal in understanding and optimizing your online presence.
2. User Registration
To access and utilize CountUp, users are required to register for an account. The registration process necessitates the provision of the following information:
• Email: serves as the primary point of contact and username.
• Password: choose a unique, secure password.
• Name: used for personalization and correspondence.
While email confirmation is not currently required, we may implement verification in the future to enhance security and authenticity.
3. User Obligations
Users are solely responsible for all activities under their account. You must maintain the security and confidentiality of your password and account details. We are not liable for any damages or losses arising from your failure to secure your account or from unauthorized access.
Users must not misuse CountUp data for malicious activities, share credentials, or use bots/automated scripts to access the service. Unauthorized access to non-public areas or other users’ accounts is prohibited, as is interference with our servers or networks.
4. Pricing and Usage
CountUp is currently in a closed beta phase and offered free of charge under a fair use policy. Excessive or abusive usage that strains our resources may be limited or suspended to ensure a stable experience for all users.
After beta, we will introduce a pricing structure. You will not be auto-transitioned to a paid plan; we will notify you in advance, giving you the choice to continue or cancel. We reserve the right to delete all tracking data at any time, but will provide an export of your data before doing so.
5. Account Cancellation and Termination
To delete your CountUp account during beta, email request@countup.io. Upon confirmation, all data will be permanently removed. We reserve the right to suspend or terminate accounts for any reason, which may result in loss of access and data.
6. Data Privacy and Protection
CountUp tracks overall trends, not individuals: measurements are fully anonymous and do not collect personal data. A complete list of collected data points is available here.
You retain 100% ownership of your tracking data. We claim no rights over it; it is never sold, shared, mined, or monetized. You may delete your account or site stats at any time, but deletion is irreversible.
We implement robust security measures and comply with all applicable laws to protect your data.
7. Service Expectations and Support
CountUp is provided “as is.” We strive for quality but cannot guarantee service will meet every requirement or be error-free. Service availability is not guaranteed. Support is provided via email on a best-effort basis. For maintenance or security, we may need discretionary access to your data.
8. Intellectual Property Rights
All content and functionality of CountUp—including software, text, graphics, logos, and trademarks—are our property or that of licensors. You may not reproduce, distribute, or create derivative works without our prior written consent.
By submitting feedback or suggestions, you grant us the right to use and develop them without obligation.
9. Liability and Disclaimer
CountUp is provided without warranty, express or implied. We are not liable for indirect, incidental, or consequential damages. Our total liability for any claim will not exceed the amount you paid in the 12 months prior to the claim.
10. General Conditions
These Terms are governed by German law, with disputes submitted to the courts of Berlin, Germany. If any provision is found invalid, the remaining provisions remain enforceable.
These Terms constitute the entire agreement and supersede prior understandings. We may modify these Terms at any time; continued use of CountUp after changes constitutes acceptance.
